Plant variety rights protects new varieties of plants, meaning no one can sell, export, import or produce the seed or propagating materials of such protected (registered) plant variety without the registered breeder’s (owner’s) permission. Through these rights, the plant breeders are encouraged to develop new varieties of plants and their contribution is recognized. A plant variety cannot be protected under Patents Act in India.
